My sincere hope is that the Canadian Supreme Court, given all the negative press heaped on these commissions lately, issues a smackdown as they did with regards to "common law" versus actual marriage. (Google the decision--it's a classic.) Failing that, I think that this is going to be a serious issue for Canada because, yeah, there is going to be a chilling effect if anyone can say to some arbitrary commission, "My feelings were hurt, he should be punished...".
