It's not a banana republic, it's New York state!
You know your state is in bad shape when the governor has to "secretly" swear-in his new lieutenant governor and then try to defend it as legal:
The governor said his appointment of Ravitch is legal because "there's nothing in the Constitution that says it can't be done," although he did admit this is "not the clearest delineation of duty that the Constitution can find."
UPDATE: My friend Sara facebooks that the secret signing took place at Brooklyn's legendary steakhouse Peter Luger's.

Posted by: nds at July 9, 2009 03:50 PMActually the NY Constitution clearly say that a Lt. Governor can't be be elected anytime other then at the same time as the Gov'nor. If there is no President of the Senate (or two unable to exercise the power), then the duties should fall to the Speaker of the Assembly. There is no provision for an appointment of a Lt. Gov by the governor. The constition do not grant him the power to appoint therefore he do not have the power to appoint a lt. gov. To say that because the constitution do not forbid the act make it legal is a bit dubious.

"In case of vacancy in the office of lieutenant-governor alone, or if the lieutenant-governor shall be impeached, absent from the state or otherwise unable to discharge the duties of office, the temporary president of the senate shall perform all the duties of lieutenant- governor during such vacancy or inability."
But hey, when did any Constitution matter?

I can't think of a more secret place to go than Peter Luger. Who goes there? That place is a ghost town.

Even though the incumbocrats in Albany would like you believe things are now all back to normal, the State has shown it seriously needs reform.
We can start by changing the process of filling vacancies for statewide office.
The governorship should be filled by the Lt Governor. But all other statewide seats, the 2 US Senators, Attorney General, Comptroller & Lt Governor should be filled by legislative election. All occupied statewide offices shall nominate a candidate or candidates for the vacant office. Both Houses of the legislature will then cast one voter for one representative totalling 212 (unless that total changes) votes.
